This website is operated by LEAVE LLC ("LEAVE," "we," "us," or "our"). Throughout the Website, the terms "you" and "your" refer to users, visitors, and customers.

These Terms of Service ("Terms") govern your use of leave.travel (the "Website") and purchases made through the Website.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services to you.

By visiting our Website, purchasing from us, participating in the LEAVE Passport Program, submitting content, or otherwise using our services, you agree to these Terms together with our Privacy Policy, Shipping Policy, Refund Policy, and any other policies or terms referenced on the Website.

If you do not agree to these Terms, you should not use the Website or purchase products through it.

3. ELIGIBILITY

By using the Website or placing an order, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you.

If you are under the age of majority in your jurisdiction, you may only use the Website or make purchases with the involvement and permission of a parent or legal guardian.

4. USE OF THE WEBSITE

You may use the Website only for lawful purposes.

You agree not to:

• Violate our intellectual-property rights or those of another person;

5. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display our products, colors, dimensions, materials, photographs, and descriptions accurately.

However, colors and appearance may vary depending on your device, screen, lighting, and other factors.

Because some LEAVE products are small and may contain detailed designs, minor variations in stitching, embroidery, positioning, color, texture, dimensions, or manufacturing may occur. Such minor variations that do not materially affect the product's intended function are not necessarily defects.

Product measurements are approximate unless expressly stated otherwise.

We may modify, discontinue, or limit products at any time.

6. MICRO FLAG PATCHES

LEAVE Micro Flag Patches are collectible travel accessories designed for compatible hook-and-loop surfaces.

Product pages will identify applicable dimensions, materials, attachment methods, and other relevant specifications.

Availability varies by country design. We do not guarantee that every country, territory, or flag will be available at all times or that a particular design will be released.

Requests or suggestions for future flags are welcome, but submitting a suggestion does not guarantee that LEAVE will produce that flag.

7. SLING BAGS AND OTHER PRODUCTS

Specifications for LEAVE bags and accessories, including materials, dimensions, storage capacity, patch capacity, hardware, and features, will be described on the applicable product page.

Statements regarding the number of patches that fit on a product assume LEAVE Micro Flag Patches arranged in the manner contemplated by the product design. Actual capacity may vary depending on placement or the use of third-party patches.

Unless expressly stated otherwise, Flag Patches are sold separately from LEAVE bags.

8. PRODUCT AVAILABILITY

All products are subject to availability.

Adding an item to your cart does not reserve inventory.

We may limit quantities purchased per customer, order, household, payment method, or shipping address.

If a product becomes unavailable after you place an order, we may cancel the affected product and refund the amount paid for it.

We may also refuse or cancel orders that we reasonably believe are fraudulent, unauthorized, made in error, or intended for unauthorized commercial resale.

9. PREORDERS AND COMING-SOON PRODUCTS

Certain products may be offered for preorder before they are available for immediate shipment.

When purchasing a preorder product, the applicable product page will provide an estimated shipping or availability timeframe where reasonably possible.

Estimated dates are estimates, not guaranteed delivery dates. Manufacturing, freight, customs, carrier delays, and other circumstances may cause estimates to change.

If a significant delay occurs, we may notify affected customers and provide any cancellation or refund options required by applicable law or stated in the applicable preorder terms.

Products marked Coming Soon, Notify Me, or similar are not available for purchase unless the Website expressly provides a preorder option.

Signing up for a product notification does not reserve inventory or guarantee that the product will become available.

10. ORDERS

Submitting an order constitutes an offer to purchase the products in your order.

After submitting an order, you should receive an electronic confirmation acknowledging that we received it.

We reserve the right to accept, decline, or cancel an order for legitimate reasons, including:

• Pricing or description errors;
  
• Payment authorization failure;
  
• Suspected fraud;
  
• Shipping restrictions;
  
• Violation of these Terms; or
  
• Technical errors.
  

If we cancel an order after payment has been collected, we will refund the applicable amount.

11. PRICING

Shipping charges, taxes, duties, and other applicable charges may be calculated separately at checkout.

We may change product prices at any time. Price changes will not ordinarily affect orders already accepted.

Despite our efforts, pricing errors may occasionally occur.

If we discover a material pricing error after an order is placed, we may contact you and provide the option to purchase the product at the correct price or cancel the affected item for a refund.

We are not obligated to honor an obviously erroneous price where permitted by applicable law.

12. DISCOUNTS AND PROMOTIONS

LEAVE may offer discounts, bundles, quantity discounts, promotional codes, gifts, or other promotions.

Promotions may be subject to separate eligibility requirements, expiration dates, minimum purchases, product exclusions, geographic restrictions, or other conditions.

Unless expressly stated otherwise:

• Discounts cannot be redeemed for cash;
  
• Promotions may not be combined;
  
• Discounts apply only to eligible products;
  
• Shipping and taxes do not count toward quantity or spending thresholds unless stated otherwise; and
  
• Promotions may be modified or discontinued where permitted by law.
  

If LEAVE offers quantity-based Micro Flag Patch pricing, such as purchasing 3, 5, or 10 eligible patches at a promotional price, the Website and checkout will determine the applicable discount.

Customers are responsible for ensuring the required quantity of eligible products is in their cart before completing checkout.

13. PAYMENT

Payment is due at checkout unless otherwise indicated.

Available payment methods are displayed during checkout and may change over time.

Payments are processed through Shopify and applicable third-party payment providers. LEAVE does not directly store your complete credit or debit card number.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Your payment provider may impose additional terms.

14. SHIPPING AND DELIVERY

LEAVE offers shipping to destinations made available at checkout.

Available destinations, estimated delivery times, shipping charges, free-shipping thresholds, and related information are described in our Shipping Policy or at checkout.

Delivery estimates are not guaranteed unless expressly stated otherwise.

Delays may occur due to carriers, customs, weather, holidays, high order volume, incorrect addresses, international transportation, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

Once an order has shipped, tracking information will be provided where tracking is available.

15. INTERNATIONAL ORDERS, CUSTOMS AND DUTIES

LEAVE may accept international orders.

International shipments may be subject to customs procedures, import taxes, duties, brokerage fees, VAT, or other charges imposed by the destination country.

The treatment of these charges will be communicated at checkout or in our Shipping Policy where applicable.

Where duties or taxes are not collected by LEAVE at checkout, the recipient may be responsible for paying them before delivery.

Customs processing may also cause delays outside LEAVE's control.

Nothing in this section limits rights you may have under applicable consumer law.

16. RETURNS AND REFUNDS

16.1 LEAVE offers returns within 30 days of the date your order is delivered. This return policy applies to both U.S. and international customers.

16.2 To be eligible for a return, products must be returned in the condition required by our Refund Policy. To start a return, contact us at help@leave.travel with your order number.

16.3 LEAVE will cover the cost of return shipping for eligible returns. We will provide return instructions and, where applicable, a prepaid return shipping label or other return-shipping arrangement.

16.4 Original shipping charges are non-refundable, except where required by applicable law or where the return results from an error by LEAVE.

16.5 LEAVE does not currently designate products as final sale. Eligible products may be returned in accordance with our 30-day return policy.

16.6 Once an eligible return has been received and approved, the applicable refund will be issued to the original payment method. The time required for the refund to appear may depend on your bank or payment provider.

16.7 International customers may have additional statutory cancellation, withdrawal, or return rights under the laws applicable in their country. Nothing in our voluntary 30-day return policy limits any mandatory consumer rights that apply to you.

17. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

If your order arrives damaged, defective, or materially different from what you ordered, please contact help@leave.travel as soon as reasonably possible with your order number and a description of the issue.

We may request photographs of the product and/or packaging to help us evaluate the issue. Where appropriate, LEAVE will provide a replacement, refund, or other remedy in accordance with applicable law.

LEAVE does not offer a separate voluntary product warranty. This does not limit any warranty, conformity, defect, or other consumer rights that cannot be excluded under applicable law.

18. LEAVE PASSPORT PROGRAM

LEAVE may operate a travel rewards and community program known as the LEAVE Passport Program.

The Passport Program may allow eligible customers to document countries they have visited with qualifying LEAVE products, submit travel photographs or other proof, reach travel milestones, and earn milestone rewards.

Participation is subject to these Terms and any additional Passport Program rules displayed on the Website.

Eligibility and Verification

To receive credit for a country or milestone, participants may be required to submit evidence meeting the requirements specified by LEAVE.

This may include a photograph showing the participant, qualifying LEAVE product, and sufficient context to reasonably establish the claimed location.

LEAVE may review submissions to protect the integrity of the program.

We may reject submissions that:

• Do not reasonably demonstrate the claimed location;
  
• Do not meet the stated submission requirements;
  
• Appear altered, fraudulent, duplicated, or misleading;
  
• Use another person's photograph without permission; or
  
• Otherwise violate the Passport Program rules.
  

Passport Program determinations will be made reasonably and in good faith.

19. PASSPORT PROGRAM MILESTONES AND REWARDS

LEAVE may offer rewards for reaching specified Passport Program milestones.

Examples may include milestone patches, recognition, community features, or other benefits.

The applicable milestone requirements and rewards will be displayed on the Website.

Milestone rewards:

• Have no cash value unless expressly stated otherwise;
  
• May not be transferable;
  
• May be limited to one reward per participant per milestone;
  
• May require verification;
  
• May change prospectively as the program evolves; and
  
• Remain subject to availability.
  

If LEAVE materially changes an existing milestone program, we will endeavor to do so fairly and provide reasonable notice where appropriate.

20. CHARITABLE OR IMPACT INITIATIVES

LEAVE may connect certain Passport Program milestones, products, promotions, or events with donations to nonprofit or charitable organizations.

Where we make such a commitment, the applicable Website page or promotion will explain how the donation is calculated.

Unless expressly stated otherwise, customer purchases are purchases of LEAVE products and are not themselves tax-deductible charitable donations by the customer. Any charitable contribution described as being made by LEAVE is made by LEAVE.

References to a nonprofit or charitable organization do not necessarily imply that the organization sponsors, endorses, or is formally affiliated with LEAVE unless we expressly state otherwise.

We may change future charitable partners or impact programs, but will honor commitments already made to the extent required by the applicable promotion and law.

21. CUSTOMER PHOTOS AND PASSPORT SUBMISSIONS

The Passport Program may require customers to submit photographs for verification.

You retain ownership of photographs and other original content you submit.

By submitting content for Passport Program verification, you grant LEAVE a limited, non-exclusive license to receive, store, review, reproduce internally, and otherwise process that content as reasonably necessary to administer the program.

Submitting a photograph for verification does not automatically grant LEAVE permission to use that photograph in advertising or public marketing.

Where LEAVE would like permission to feature your photograph publicly, we may separately ask you to authorize such use.

If you grant that permission, the applicable authorization may allow LEAVE to reproduce, display, publish, adapt, and share the approved content on channels such as:

• leave.travel;
  
• LEAVE social-media accounts;
  
• LEAVE email communications;
  
• Digital advertising; and
  
• Other LEAVE promotional materials.
  

Any such public-use rights will be governed by the permission or terms presented to you when you authorize the use.

You represent that you have the rights necessary to submit any content you provide and that your submission does not violate another person's privacy, publicity, copyright, or other rights.

22. REVIEWS, FEEDBACK AND OTHER SUBMISSIONS

If you submit a product review, suggestion, comment, idea, or other feedback, you retain ownership of any intellectual-property rights you hold in that material.

You grant LEAVE a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the submission for purposes reasonably connected with operating, promoting, and improving LEAVE, subject to applicable privacy law.

You agree not to submit content that is unlawful, fraudulent, defamatory, infringing, abusive, obscene, or otherwise violates another person's rights.

We may decline to publish or remove content that violates these Terms.

23. INTELLECTUAL PROPERTY

The Website and its content—including LEAVE branding, logos, product photography, illustrations, graphics, Website design, written copy, product designs, patch artwork, icons, and other original material—are owned by LEAVE or used under appropriate license and are protected by applicable intellectual-property laws.

You may access the Website for your personal, non-commercial use.

Unless authorized by us or permitted by law, you may not reproduce, distribute, sell, modify, commercially exploit, scrape, republish, or create derivative works from Website content.

Nothing in these Terms transfers ownership of LEAVE's intellectual property to you.

24. COUNTRY FLAGS AND CULTURAL INFORMATION

LEAVE products may incorporate national flags, geographic references, country names, languages, foods, landmarks, cultural information, or historical information.

National flag designs and other governmental symbols may be subject to laws, conventions, restrictions, or protections that vary by jurisdiction. LEAVE does not claim exclusive ownership over national flags themselves.

Educational or cultural information provided on product pages is intended as general informational content. While we make reasonable efforts toward accuracy, such information should not be relied upon as professional, legal, historical, travel-safety, immigration, or governmental advice.

25. THIRD-PARTY SERVICES

Our Website may contain or rely on services, applications, payment processors, analytics providers, social-media platforms, links, or tools operated by third parties.

Your use of third-party services may be governed by those parties' own terms and privacy policies.

LEAVE is not responsible for the availability, content, policies, security, or operation of independent third-party services except to the extent required by applicable law.

26. PRIVACY

Your use of the Website is subject to our Privacy Policy.

Our Privacy Policy explains how LEAVE collects, uses, discloses, and protects personal information, including information associated with purchases, marketing, analytics, and Passport Program submissions.

27. WEBSITE ACCURACY AND AVAILABILITY

We try to keep the Website accurate and available.

However, the Website may occasionally contain errors, omissions, outdated information, technical problems, or interruptions.

These may relate to product descriptions, prices, promotions, shipping charges, availability, country information, or other content.

We reserve the right to correct errors and update information where permitted by law.

We do not guarantee that the Website will always operate uninterrupted or error-free.

28. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Website and its content are provided on an "as available" basis.

LEAVE makes no warranties regarding the uninterrupted or error-free operation of the Website except where warranties cannot lawfully be excluded.

Products remain subject to any express warranties we provide and any mandatory warranties or consumer protections applicable to your purchase.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

29. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, LEAVE LLC and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or purchase of products.

To the fullest extent permitted by applicable law, LEAVE's aggregate liability arising from a particular purchase will not exceed the amount you paid to LEAVE for the product giving rise to the claim.

These limitations do not apply where liability cannot lawfully be excluded or limited, including where applicable law provides otherwise for fraud, willful misconduct, personal injury, defective products, or mandatory consumer rights.

30. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless LEAVE LLC and its affiliates, officers, employees, contractors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Website, your violation of these Terms, or content you submit in violation of another person's rights.

This provision does not apply to the extent prohibited by applicable consumer law.

31. FORCE MAJEURE

LEAVE will not be responsible for delays or failures caused by circumstances reasonably beyond our control.

Such events may include natural disasters, severe weather, fires, epidemics or pandemics, war, civil unrest, government action, labor disruptions, carrier interruptions, customs delays, transportation disruptions, telecommunications failures, or major supply-chain disruptions.

Where an event materially prevents us from fulfilling an order, we will take reasonable steps to communicate with affected customers and provide remedies required by applicable law.

32. ELECTRONIC COMMUNICATIONS

By using the Website or purchasing from us, you agree that transactional communications may be provided electronically.

These may include:

We may suspend or terminate your access to portions of the Website or LEAVE programs if you materially violate these Terms, engage in fraud or abuse, or misuse our services.

Termination does not eliminate obligations or rights that arose before termination.

Sections that by their nature should survive termination—including intellectual-property provisions, applicable licenses, liability provisions, and dispute provisions—will continue as appropriate.

35. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or modified to the minimum extent necessary.

The remaining provisions will continue in effect.

36. NO WAIVER

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver of one breach does not constitute a waiver of another breach.

37. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, and any additional terms expressly applicable to a particular program, promotion, or purchase, constitute the agreement between you and LEAVE concerning your use of the Website and purchases through it.

38. GOVERNING LAW

These Terms and disputes arising from them are governed by the laws of the State of Oregon and applicable federal law of the United States, without regard to conflict-of-law principles.

However, if you are a consumer residing outside Oregon, nothing in this choice-of-law provision deprives you of mandatory consumer protections that apply to you under the laws of your place of residence where those protections cannot lawfully be waived.

If you have a concern regarding an order, product, Passport Program decision, or these Terms, please contact us first at help@leave.travel so that we can attempt to resolve the issue.

Nothing in these Terms prevents either party from pursuing remedies available under applicable law.

Consumers outside the United States may have the right to bring disputes before courts, regulators, or consumer-dispute bodies in their country of residence. Nothing in these Terms is intended to restrict rights that cannot legally be waived.
